E-commerce Contract
The purchase of any product in the online store shopinter.com.br implies the consumer's agreement with all the terms and conditions of this Product Sales Agreement.
Whereas:
I - shopinter.com.br is a company whose main activities consist of intermediating products via the internet;
II - The user is an individual or legal entity, regularly registered with the CPF/MF or CNPJ/MF, with a correctly completed registration, whose information has been validated by shopinter.com.br;
III - The user declares to be acting in good faith and in full exercise of his/her civil capacity to enter into this Agreement, declaring that he/she has understood, read and agrees with all the terms and conditions set forth herein.
PURCHASE AND SALE PROCEDURES
Clause One: After making a request to purchase products in the virtual store, the user must wait to receive notification via email in which they will be informed about the confirmation of the requested commercial transaction.
First paragraph: shopinter.com.br reserves the right not to confirm the purchase and sale in the following cases:
I - User with incorrect or invalid registration information;
II - Deliveries to be made outside the delivery areas made available by shopinter.com.br at the time of purchase and sale;
III - Fraud and bad faith, failure to comply with any of the website's conditions and policies, abuse of rights, and/or other situations that imply violation of legal provisions or illicit enrichment on the part of the user and in other cases provided for in accordance with applicable legislation.
Clause Two: The purchase and sale value will be present in the confirmation email, and the user will be provided with the payment methods provided on the shopinter.com.br website at the time of purchase and sale.
First Paragraph: Payment by credit card may not be approved if there is an inconsistency in the cardholder's data. The bank slip generated for payment will be valid for 03 (three) business days and will be automatically cancelled if payment is not made after the aforementioned period has elapsed.
RIGHTS AND OBLIGATIONS
Return due to Regret
Clause Three: Products may be returned due to regret within 7 (seven) calendar days, counted AFTER RECEIPT OF THE PRODUCTS.
First Paragraph: To exercise regret, the user must contact shopinter.com.br, via the customer service email contato@shopinter.com.br.
Second Paragraph: After sending the regret email, the user must wait for contact from our team, who will inform the necessary procedures for replacing the item or refunding the amounts paid.
Third Paragraph: The return provided for in this clause will only be approved by shopinter.com.br after verifying:
I - The effective return of the product to the supplier's distribution center;
II - Confirmation by shopinter.com.br that the product was returned unused, in its original packaging, accompanied by labels, manuals and accessories;
III - The approval of the exchange or return by shopinter.com.br's quality control, after analysis, will be carried out within 10 business days;
Paragraph Four: If the user exercises regret in disagreement with this clause or contract and/or if any discrepancy or violation is identified in the returned product, the return will not be accepted and we will return the product to the user without prior notice.
EXCHANGE DUE TO PRODUCT DEFECT OR FAILURE
Clause Four: The exchange of products that present a manufacturing fault or defect may be carried out provided that the request is made within the legal warranty period of contact after receipt of the products, in accordance with article 26 of the Consumer Protection Code.
First Paragraph: To exercise the exchange, the user must contact shopinter.com.br via the customer service email contato@shopinter.com.br
Second Paragraph: The exchange provided for in this clause will only be approved by shopinter.com.br after verifying:
I - The effective return of the product to the supplier's distribution center;
II - Confirmation by shopinter.com.br that the product was returned together with manuals and accessories;
III - The approval of the exchange or return by shopinter.com.br's quality control will be carried out after analysis within 10 business days;
Third Paragraph: If the user exchanges the product in disagreement with this clause and/or if any discrepancy or violation of the product is identified, the return will not be accepted and we will return the product to the user without prior notice.
PAYMENT REFUND PERIOD
Clause Five: If payment was made by credit card, the refund will be made to the credit card itself and will be visible to the user within 2 (two) invoices after the refund is completed, and may vary according to the card's expiration date. Payment for products made by bank slip will be refunded to the user's own account with the financial intermediary.
DELIVERY TERMS AND CONDITIONS
Clause Six: Products are delivered from Monday to Friday, from 8 am to 9 pm and the estimated delivery period will only begin after payment confirmation and logistical processing.
First Paragraph: The product delivery service is carried out solely and exclusively by the Post Office, which is also responsible for meeting the deadlines and delivery stages to the user.
Second Paragraph: Delivery may be made directly to third parties, such as doormen or relatives.
Third Paragraph: Delivery may not be made within the stipulated period due to:
I - The user's absence at the indicated address;
II - Incorrect registration data;
III - Refusal of the product by the user or third party;
IV - Change of user address;
V - The occurrence of any force majeure event, such as floods, natural disasters, major accidents or other occasions that prevent delivery;
VI - Strike or stoppage of postal activities;
VII - The significant increase in demand for the Post Office;
VII - Due to festive seasons, such as Christmas and New Year.
Paragraph Four: The deadline for delivery of products is 15 to 45 business days after posting, according to the rules of the Post Office. The deadline may be extended to up to 90 business days for the reasons expressed in Paragraph Three of this clause.
Clause Seven: This contract aims to ensure easy service to the consumer, in accordance with the provisions of section IV of article 4 of Decree No. 7,962/13.
Clause Eight: shopinter.com.br reserves the right to cancel the commercial transaction in the event of any situation being identified that characterizes fraud, bad faith, non-compliance with any of the website's conditions and policies, abuse of rights, and/or other situations that imply violation of legal provisions or illicit enrichment.
Clause Nine: The relationship between shopinter.com.br and the user is regulated exclusively by the conditions established in this contract.
FORUM
Clause Ten: The forum for resolving any issue pertaining to this contract will be the consumer's domicile.
